The following disclaimers outline important limitations on our responsibilities and clarify key aspects of our services. By accessing our website, making a booking, or using our services, you acknowledge and agree to these disclaimers.

These disclaimers are provided in compliance with Nigerian law, including the *Federal Competition and Consumer Protection Act (FCCPA) 2018*, which prohibits unfair contract terms while allowing reasonable limitations of liability where permissible. They also align with international best practices for travel agencies and the terms of our payment processors, Paystack and Flutterwave.

Nature of Our Role

We Act as an Intermediary
Polytravis acts solely as an *agent* or intermediary in arranging travel services on your behalf. We do not own, operate, manage, supervise, or control third-party suppliers such as airlines, hotels, tour operators, cruise lines, ground transportation providers, visa authorities, or other service providers (“Suppliers”).

  • All travel arrangements are subject to the terms, conditions, limitations of liability, and cancellation policies of the respective Suppliers.
  • We do not assume liability for the acts, omissions, negligence, willful misconduct, or failure to perform by any Supplier.
  • Any disputes regarding the quality, safety, delivery, or performance of services must be directed to the relevant Supplier.

No Ownership or Operation of Travel Services

We do not own or operate aircraft, hotels, vehicles, vessels, railways, or other transportation or accommodation facilities. Therefore, we disclaim any responsibility or liability for:

  • Delays, cancellations, overbookings, schedule changes, route alterations, or service disruptions caused by Suppliers.
  • Baggage loss, damage, or delay.
  • Personal injury, illness, death, property damage, or other losses arising from the use of any Supplier’s services.
  • Compliance of facilities or amenities with standards (e.g., air-conditioning, accessibility, hygiene, or safety features that may differ from expectations or international norms).

Disclaimer of Warranties

All information, content, prices, availability, descriptions, and services on polytravis.com or provided by us are offered “as is” and “as available” without any warranties of any kind, express or implied, to the fullest extent permitted by law. This includes, but is not limited to:

  • Warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement, or uninterrupted/error-free access.

  • Direct, indirect, incidental, special, consequential, exemplary, or punitive damages.
  • Loss of profits, revenue, data, goodwill, business opportunities, or other intangible losses.
  • Personal injury, emotional distress, property damage, or death arising from travel arrangements.
  • Damages arising from force majeure events (e.g., natural disasters, pandemics, war, terrorism, strikes, government actions, or other events beyond our control).

Where liability cannot be excluded by law, our total liability (whether in contract, tort, negligence, strict liability, or otherwise) shall be limited to the amount you paid us for the specific service or booking giving rise to the claim, or such lower amount as may be required under applicable law.

Assumption of Risk

Travel involves inherent risks, including but not limited to political instability, health hazards, crime, natural disasters, accidents, and varying standards of infrastructure and services. By booking with us, you:

  • Acknowledge and voluntarily assume these risks.
  • Confirm you are in suitable health and physical condition for the planned travel.
  • Agree to obtain appropriate travel insurance covering medical emergencies, trip cancellation/interruption, baggage loss, and other risks.

We strongly recommend purchasing comprehensive travel insurance before booking.

Changes and Force Majeure

Prices, itineraries, and availability are subject to change without notice due to Supplier adjustments, currency fluctuations, taxes, or other factors. In force majeure situations, we will assist where possible but assume no liability for resulting losses.

Governing Law and Severability

These disclaimers are governed by the laws of the Federal Republic of Nigeria. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
